In the draft decree sent on 12 January by Marcelo Rebelo de Sousa to the Assembly of the Republic, which takes effect from 14 to 30 January, the right to international circulation is again restricted - which had already happened in the first phase of the state of emergency, between March and May.
"Border controls on persons and goods, including sanitary and phytosanitary controls at ports and airports, may be established by the competent public authorities, in liaison with the European authorities and in strict compliance with the EU Treaties", reads the new article included in the law.
These controls may be imposed "with the aim of preventing entry into national territory or making such entry subject to compliance with the conditions necessary to avoid the risk of the spread of the epidemic or the overburdening of resources for combating it, in particular by requiring the performance of a diagnostic test for SARS-CoV-2 or the compulsory confinement of persons in a place defined by the competent authorities", it adds in the same article.
