"Breach of contract remains a scourge of the national
rental market in the first six months of 2022: one in four respondents in the
5th edition of the ALP Barometer (24.4%) has rent arrears", concluded the ALP
study.
Among those who have rent arrears, a third of the defaults
reach up to three months of rent arrears, but a significant portion of 28% of
respondents have more than half a year of rent yet to be received.
Even so, the association pointed out, more than half of
landlords with defaulting tenants (54.4%) admitted that they will not go to
court or instruct evictions.
Crazy that around half of landlords owed money, often serious amounts, won't even bother with court action to recover arrears or request eviction. I can't begin to understand how their minds work. How do they hope to recover the arrears without taking action? Do they think waving a magic wand and waiting an eternity will miraculously solve it all?

In practice, Pt ppl are used to seeing authorities do nothing, they know they´ll waste time/money and after all that the risk of Justice eluding them is just too great. I can tell you just as a customer I´ve been shafted by so many services, and robbed, and ASAE only answers e-mails 4-5 months later (they´re full of these complaints) and when it comes to getting justice/your money back it´s UP TO YOU to pursue legally. They´re too busy raiding fairs where people try to buy basics at affordable prices, you see? So, too understaffed to do anything. I´ve been duped/robbed by (just these past 2-3 years?): PROGIGATEC; AT INFORMÁTICA (on behalf of NILFISK), NILFISK CUSTOMER SUPPORT(are you laughing yet, B.Bisset?), the previous owner of the self service laundry shop (money charged in my card for extra washings…magically disappeared. The machine not giving tickets proving you´ve just charged, convenient, no?)… If you have money to waste outsourcing the solving of these pbs, go ahead then, People feel dupped because it costs money/time they don´t have; pbs pilling up so you address the priority ones. Your reasoning makes sense in a country that knows the concept of “Customer service/support”. Does Portugal strike you as such a country, or the majority of the ppl barely scrapping by strike you as people with means/time to waste in the end? And on so many fronts at once? I believe you meant well-I understand the constructive side of your reasoning- but some ppl have busier/poorer lives than others. These services know, and prey on that. People already have to manage other horror merry-go-rounds on a daily basis.

It might sound crazy, but I assume there are reasons for it. These might be very long durations and high legal costs to get a verdict, without the ability to recover the cost from the tenant. Unpredictability of court decisions. Unpredicability of tenants reaction (destroy your apartment). Lost of things really.

As in most of the world, but much more so in Portugal, renting a unit long term is a very serious mistake. The law protects tenants no matter the damage done / money stolen. Tenants often get away with near murder with no trouble from authorities, while landlords are considered criminals just for requesting payment of arrears.
Portugal doesn't have enough housing. It is no wonder. Who in their right minds would invest in rental contracts under this draconian situation?

James from Algarve is right. Landlords won’t use contracts so as to avoid the high taxes on the rent (about 30%). They can be totally dishonest with tenants. I know of one just happened where owner has been charging 600 E/ month for something on 4th level / no lift and various problems with plumbing. When the tenant said they were moving out, owner refused to give back deposit of 1500 E until the flat was painted and until the tenant found a new tenant !
NO contract ! Still not even certain that the tenants will recover their deposit at this stage.
